Appellant appeals his conviction in a jury trial for possession of a controlled substance, heroin. Article 4476-15, ? 4.04, V.A.C.S. His punishment, enhanced by allegation and proof of a prior felony conviction, was assessed by the jury at twelve years confinement in the Department of Corrections. The Fourteenth Court of Appeals (Houston) affirmed the conviction in a published opinion. Lunde v. State, 720 S.W.2d 251 (Tex.App. - Houston [14th] 1986). We granted appellants petition for discretionary review to determine whether the appeals court erred in concluding that the arrest and subsequent search of appellant was justified under Article 14.01(b), V.A.C.C.P. We will affirm the judgment of the Court of Appeals.
